Dibattito 1
Vi sono casi in cui la legge prevede in capo all\u2019Amministratore particolari responsabilit\u00e0, che vanno oltre le sue tipiche attribuzioni: si pensi, ad esempio, alla responsabilit\u00e0 in materia di impianti termici (DPR 74\/2013) o a quella del committente, quale responsabile dei lavori, ai fini della sicurezza (D. Lgs. 81\/2008). Ci si chiede se sia valida una clausola inserita nell\u2019offerta professionale dell\u2019Amministratore che preveda l’esclusione di queste responsabilit\u00e0 o se, comunque, vi siano altre soluzioni a tal fine.<\/p>\n\n\n\n

In caso di appalto avente ad oggetto opere che godono del beneficio fiscale, ci si chiede quali siano le sorti del contratto qualora l’impresa non abbia i requisiti richiesti dalla legge a tal fine (ad esempio, DURC, SOA, patente a crediti, ecc) e su quali soggetti, eventualmente, ricadano le relative responsabilit\u00e0.<\/p>\n\n\n\n

Attese le due sentenze recenti della Corte di Cassazione (nn. 28195 e 28196 del 31 ottobre 2024) secondo le quali \u00e8 affetta da nullit\u00e0 la delibera che ha affidato l\u2019amministrazione del condominio a professionista non in possesso dei requisiti dell\u2019art. 71-bis disp.att.c.c., ed il conseguente contratto, si chiede se gli atti compiuti dallo stesso siano o meno validi e su chi ricadano le eventuali conseguenze.<\/p>\n\n\n\n
